1. Acceptance of these terms
These Terms of Service ("Terms") govern your use of the Rally mobile application and any related services provided by Rally ("we", "us", "our") (together, the "Service").
By creating a Rally account, signing in, or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Service.
If you are using the Service on behalf of another person or entity, you represent that you have the authority to bind that person or entity to these Terms.
2. Definitions
- "User", "you", "your" — anyone who creates an account or uses the Service.
- "Match" — a padel match posted by a User through the Service, including the venue, date, time, level range, gender preference, cost-per-player figure, and roster.
- "Roster" — the four players who have joined a Match.
- "Venue" — the third-party padel facility where a Match is played. Venues are not affiliated with Rally and are not operated by Rally.
- "User Content" — anything you submit to the Service, including profile information, photos, chat messages, scores, match listings, and reports.
3. What Rally is — and what Rally is not
3.1 What Rally is
Rally is a platform that lets padel players in Pakistan post matches they have independently booked, find other players to fill open spots, coordinate via in-app chat, and record scores after the match.
3.2 What Rally is not
This is important. Read it carefully.
- Rally is not a party to any Match. Matches are posted, joined, and played entirely between Users. Rally is not present at any Match and has no role in any Match beyond providing the platform that connects the Users involved.
- Rally does not book courts on your behalf. All court bookings are made by Users directly with Venues, before or independently of using the Service. Rally has no relationship with any Venue, does not pay any Venue, and does not receive bookings on behalf of any Venue.
- Rally does not process payments between Users. The cost-per-player figure shown for a Match is an estimate provided by the User who posted the Match. Settling that cost — collecting it, splitting it, or refunding it — is entirely a matter between the Users on the Roster. Rally does not collect, hold, route, refund, or guarantee any payment.
- Rally does not verify any User. We do not verify the identity of any User, the skill level claimed by any User, the gender claimed by any User, the accuracy of any User's profile, the truthfulness of any User's chat messages, or the conduct of any User on or off the platform.
- Rally does not verify any Match. We do not verify that a Match has been booked, that the booking is valid, that the Venue exists, that the Venue is open, that the listed time is accurate, that the listed cost is correct, or that the Match will take place as posted.
- Rally does not verify any Venue. We do not vet Venues for safety, cleanliness, accessibility, equipment quality, or legitimacy. Venue names and locations are pulled from third-party sources (e.g., Google Places) and may be inaccurate, outdated, or fraudulent.
- Rally is not an introduction service, a dating service, a sports league, or a coaching service. Rally is a directory of self-organized matches.
4. Assumption of risk
By using the Service, you acknowledge and agree that you assume all risk associated with your use of the Service and your participation in any Match. This includes, without limitation:
- Physical risk. Padel is a physical sport. You may suffer injury, illness, or death from playing, from contact with other players, from the Venue's facilities, or from accidents in transit. Rally is not responsible for any such injury, illness, or death.
- Interaction risk. Other Users may not be who they say they are, may not have the skill level they claim, may not show up, may show up at a different time, may behave inappropriately, may harass you, may steal from you, or may otherwise act in ways that cause you harm or loss. Rally is not responsible for the conduct of any other User, on the platform or off.
- Transit risk. Travelling to and from a Venue carries the same risks as any other travel. Rally is not responsible for your transit.
- Property risk. Items you bring to a Match may be lost, stolen, or damaged. Rally is not responsible for any such loss.
- Payment risk. If you and other Users agree to share the cost of a court booking, that arrangement is between you. If another User fails to pay their share, refuses to pay their share, pays the wrong amount, or disputes the amount, that is a matter for you to resolve directly with them. Rally is not a party to any payment arrangement and has no obligation to mediate, refund, recover, or guarantee any payment.
- Venue risk. Venues may be closed, double-booked, unsafe, or fraudulent. Rally has no relationship with any Venue and is not responsible for any Venue's conduct, facilities, or availability.
- Cancellation risk. Matches may be cancelled by the poster, by other players leaving, or by the Venue. Rally is not responsible for any loss or inconvenience caused by a cancellation.
- Information risk. Any information another User provides about themselves, about a Match, or about a Venue may be false. You are responsible for verifying anything you rely on before attending a Match.
You meet other Users at your own risk. You attend Matches at your own risk. You pay other Users at your own risk.
5. Eligibility and account registration
5.1 Minimum age
You must be at least 18 years old to create a Rally account. Rally is intended only for adults. Because Matches arranged through Rally involve meeting other Users in person, the Service is restricted to adults, and both app stores list Rally with an 18+ age rating. If we learn that someone under 18 has created an account, we will remove it.
5.2 Accurate registration
You must provide accurate, current, and complete information when you register and when you use the Service. You must keep that information up to date. You are responsible for all activity that occurs under your account.
5.3 One account per person
You may not create more than one Rally account. You may not register on behalf of anyone else without their authorization. You may not create an account using a false identity.
5.4 Authentication
Rally uses third-party authentication providers (Apple, Google). You are responsible for maintaining the security of your Apple or Google account. If your Apple or Google account is compromised, your Rally account may be compromised too.
6. Acceptable use
You agree that you will not:
- Use the Service to harass, abuse, threaten, defame, or harm any other User.
- Use the Service to send unsolicited commercial messages, spam, or scams.
- Use the Service to share content that is unlawful, fraudulent, obscene, hateful, or that infringes anyone's rights.
- Impersonate another person, misrepresent your affiliation with anyone, or create an account with a false identity.
- Create matches you have not booked, matches at venues that do not exist, matches with false cost figures, or matches with false level or gender requirements.
- Submit false scores, false no-show reports, or false disputes.
- Scrape, copy, mirror, harvest, or otherwise extract data from the Service for any purpose, including building a competing service.
- Reverse-engineer, decompile, modify, or attempt to gain unauthorized access to the Service or any system Rally uses to operate the Service.
- Use the Service for any commercial purpose without our prior written permission, including but not limited to coaching, paid match arrangement, equipment sales, or recruitment.
- Use the Service in any way that violates any applicable law of Pakistan or any other jurisdiction you are located in.
We may remove content, suspend accounts, or terminate accounts that violate this section, in our sole discretion, with or without notice.
7. Account suspension and termination
7.1 By Rally
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms or our Privacy Policy.
- Triggering Rally's internal reliability thresholds (excessive no-shows, cancellations, or disputes).
- Behaviour we reasonably consider harmful to other Users or to the Service.
- Suspected fraud, impersonation, or unauthorized use of the Service.
- A request from a court, government authority, or law enforcement agency under Pakistan law.
Suspension or termination does not entitle you to any refund.
7.2 By you
You may terminate your account at any time via Settings → Delete Account. Deletion removes your account, profile, match memberships, chat messages, and notifications. Some data may persist where we are legally required to retain it, as described in our Privacy Policy.
7.3 Effect of termination
Sections that by their nature should survive termination — including Sections 4 (Assumption of risk), 8 (User Content), 9 (Intellectual property), 10 (Disclaimers), 11 (Limitation of liability), 12 (Indemnification), and 13 (Dispute resolution) — survive termination.
8. User Content
8.1 You own your content
You retain ownership of any User Content you submit to the Service.
8.2 Licence to Rally
By submitting User Content to the Service, you grant Rally a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, modify (only for technical purposes such as resizing photos), display, perform, and distribute that User Content as necessary to provide the Service and to operate, develop, and improve the Service.
This licence is limited to what is necessary for the Service. It does not give Rally the right to commercialize your User Content separately from the Service.
8.3 Your responsibilities
You are solely responsible for your User Content. You represent and warrant that:
- You own or have the necessary rights to your User Content.
- Your User Content does not infringe the rights of any third party.
- Your User Content does not violate these Terms or any applicable law.
8.4 Moderation
We may, but are not obligated to, review, remove, or refuse to display any User Content for any reason, including violations of these Terms.
8.5 Chat messages
Chat messages you send in a Match thread are visible to all Users on that Match's Roster. You may delete your own chat messages via the long-press action in the chat. Other Users on the Roster will see deleted messages replaced with a tombstone marker. Chat messages are hard-deleted thirty (30) days after the Match's scheduled start time, as described in the Privacy Policy.
8.6 Reports
If you become aware of User Content that violates these Terms, you may report it to support@rally.pk. We will review reports and take action at our discretion.
9. Intellectual property
The Service — including the Rally name and logo, the design and layout of the app, the source code, the underlying database structure, and all other content created by Rally — is the exclusive property of Rally and is protected by intellectual property laws of Pakistan and other jurisdictions.
You may not copy, modify, distribute, sell, lease, or create derivative works of any part of the Service without our prior written permission. You may not use the Rally name, logo, or any other Rally brand element without our prior written permission.
If you believe content on the Service infringes your copyright, send a written notice to legal@rally.pk identifying the copyrighted work, the location of the allegedly infringing material on the Service, your contact details, and a statement that you have a good-faith belief that the use is unauthorized.
10. Disclaimers
The Service is provided on an "as-is" and "as-available" basis, without warranties of any kind, whether express or implied, to the maximum extent permitted by Pakistan law.
Without limiting the above, Rally specifically disclaims:
- Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
- Any warranty that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components.
- Any warranty as to the accuracy, completeness, or reliability of any Match listing, User profile, Venue listing, chat message, or any other content displayed in the Service.
- Any warranty as to the identity, skill level, character, conduct, or fitness of any other User.
- Any warranty as to the safety, accessibility, availability, or legitimacy of any Venue.
- Any warranty that any Match will take place as posted.
- Any warranty as to any communication, agreement, or arrangement you make with another User on or off the Service.
No advice or information, oral or written, that you obtain from Rally or from any other User creates any warranty that is not expressly stated in these Terms.
11. Limitation of liability
To the maximum extent permitted by Pakistan law:
11.1 Excluded damages
In no event will Rally, its operators, affiliates, employees, agents, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation damages for loss of profits, loss of goodwill, loss of data, loss of opportunity, business interruption, personal injury, property damage, or emotional distress, arising out of or in connection with these Terms, the Service, or any Match, even if Rally has been advised of the possibility of such damages.
11.2 Liability cap
If, despite Section 11.1, Rally is found liable to you for any reason, Rally's total aggregate liability to you under these Terms will not exceed the greater of (a) one thousand Pakistani Rupees (PKR 1,000) or (b) the total amount of fees you have paid to Rally in the twelve (12) months preceding the event giving rise to liability.
11.3 No liability for other Users or for Venues
Without limiting the above, Rally is not liable for:
- The conduct of any other User, on the Service or off the Service, before, during, or after any Match.
- Any injury, illness, or death you suffer at any Match, in transit to or from any Match, or as a result of any Match.
- Any loss of, damage to, or theft of any property at any Match or in connection with any Match.
- Any failure of any other User to attend a Match, to pay their share of any cost, or to behave appropriately.
- Any act or omission of any Venue, including but not limited to closure, double-booking, unsafe conditions, or fraud.
- Any payment, refund, or financial arrangement between you and any other User.
11.4 Carve-out
Nothing in these Terms excludes or limits Rally's liability for fraud, gross negligence, or wilful misconduct, or for any liability that cannot be excluded or limited under Pakistan law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Rally, its operators, affiliates, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of the Service.
- Your User Content.
- Your conduct on the Service or in connection with any Match (including off-platform conduct related to a Match).
- Your interactions with any other User.
- Your breach of these Terms.
- Your violation of any law or of any third party's rights.
Rally reserves the right, at our own expense, to assume the exclusive defence and control of any matter for which you are required to indemnify us. You agree to cooperate with our defence of any such claim.
13. Dispute resolution
13.1 Informal resolution first
If you have a dispute with Rally, please contact us at legal@rally.pk before initiating any formal proceeding. We will attempt to resolve the dispute informally within thirty (30) days.
13.2 Arbitration
If informal resolution does not resolve the dispute within thirty (30) days, any dispute arising out of or in connection with these Terms, the Service, or any Match — including disputes about the formation, validity, interpretation, breach, or termination of these Terms — will be resolved by binding arbitration before a single arbitrator under the Arbitration Act, 1940 of Pakistan, seated in Islamabad. The arbitration will be conducted in English. The arbitrator's award will be final and binding on both parties.
13.3 Class action waiver
You and Rally agree that disputes will be resolved on an individual basis only. Neither you nor Rally may bring a claim against the other as a plaintiff or class member in a class action, consolidated action, or representative action.
13.4 Carve-out for courts
Notwithstanding Sections 13.2 and 13.3, either party may bring a claim in a court of competent jurisdiction in Islamabad for:
- An action to enforce Rally's intellectual property rights or confidentiality obligations.
- An action for injunctive or other equitable relief to prevent imminent harm.
- A small claim that qualifies for resolution in a small claims court under Pakistan law.
13.5 Governing law
These Terms are governed by the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-laws provisions.
13.6 Jurisdiction for non-arbitrable matters
For any matter not subject to arbitration under Section 13.2, you and Rally submit to the exclusive jurisdiction of the courts of Islamabad.
14. Third-party services
The Service relies on third-party services, including Apple Sign In, Google Sign In, Google Places API, Supabase, Apple Push Notification service, Firebase Cloud Messaging, and Expo Push. Your use of those services is governed by the terms and privacy policies of their providers. Rally is not responsible for any third-party service.
If a third-party service is unavailable, the Service or parts of it may also be unavailable. Rally is not liable for any disruption caused by a third-party service.
15. Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you in the app or by email at least seven (7) days before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and delete your account before the changes take effect.
16. General
16.1 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rally regarding the Service. They supersede any prior agreement or understanding.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable, preserving its original intent.
16.3 No waiver
Rally's failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision.
16.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Rally may assign or transfer its rights and obligations under these Terms without your consent.
16.5 No agency
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and Rally.
16.6 Force majeure
Rally is not liable for any failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, war, terrorism, civil unrest, power outages, internet failures, or government action.
16.7 Notices
We will send notices to you at the email address associated with your account. You will send notices to us at legal@rally.pk. Notices are deemed delivered when sent.
16.8 Language
These Terms are written in English. Any translation is provided for convenience only. In the event of a conflict between the English version and any translation, the English version controls.
